This Privacy Policy explains how Ava Deniz Araçları Sanayi ve Ticaret Ltd. Şti. ("AvA Yachts", "we", "us", "our") collects, uses, shares, and protects your personal data when you visit avayachts.com, contact us, or interact with us across our communication channels. It also explains your rights and how to exercise them.
We are committed to processing personal data lawfully, fairly, and transparently, in accordance with the Turkish Personal Data Protection Law No. 6698 ("KVKK") and, where applicable, the EU General Data Protection Regulation ("GDPR").

- Identity and contact details: name, surname, email address, phone number, country, company, and job title (for example, when you fill in a contact form, request information, or message us on any channel).
- The content of your messages and enquiries (including via our website chat assistant, email, WhatsApp, Telegram, Instagram, and Facebook).
- Information you share during the sales process, at boat shows, or in meetings.
b) Data collected automatically
- Technical data: IP address, browser type and version, device and operating system, time-zone setting, and language.
- Usage data: pages visited, referring pages, date and time, and duration of visits.

c) Marketing-interaction data
- Whether you open our marketing emails and which links you click (only for emails sent on a consented marketing basis).

5. The AvA Yachts Chat Assistant
Our website offers an AI-assisted chat feature to help answer your questions. If you use it:
- The conversation is logged and stored in our CRM so we can follow up and improve our service.
- If you voluntarily provide contact details (such as an email or phone number), we may use them to respond to your enquiry and, where you have consented, for follow-up.
- Please do not enter sensitive personal data into the chat. Provide only what is needed to answer your question.
6. Who We Share Your Data With
We do not sell your personal data. We may share it with:
- Service providers (data processors) who help us operate, such as our website host, email-delivery provider (Mailgun), and CRM/communication tools — bound by contract to process data only on our instructions.
- Brokers and business partners where relevant to a sales enquiry you have initiated or consented to (for example, an international brokerage handling your interest in a specific yacht).
- Authorities or advisers where required by law, to establish or defend legal claims, or in connection with a corporate transaction.
We require all processors to provide appropriate safeguards for your data.
7. International Transfers
Some of our service providers (for example, email, analytics, and messaging platforms) are located outside Türkiye and the EU/EEA, including in the United States. Where we transfer your personal data abroad, we do so in accordance with KVKK Article 9 and GDPR Chapter V, relying on your explicit consent and/or appropriate safeguards such as the European Commission's Standard Contractual Clauses. 8. How Long We Keep Your Data (Retention)
We keep personal data only as long as necessary for the purposes described, then delete or anonymise it. Indicative periods:
- Enquiry/lead data: for the duration of the sales relationship and up to 3 years afterwards, unless you ask us to delete it sooner.
- Marketing data: until you withdraw consent or unsubscribe, and then only as needed to record that withdrawal.
- Chat and message logs: 24 months, after which they are deleted or anonymised.
- Accounting/legal records: for the statutory retention period required by Turkish law.
9. Your Rights
Under KVKK Article 11, you have the right to:
- learn whether your personal data is processed, and request information about it;
- learn the purpose of processing and whether data is used accordingly;
- know the third parties to whom data is transferred (domestically or abroad);
- request correction of incomplete or inaccurate data;
- request erasure or destruction of your data within the conditions of the law;
- request notification of correction/erasure to third parties to whom data was transferred;
- object to results arising solely from automated analysis;
- claim compensation for damage arising from unlawful processing.
Where GDPR applies, you additionally have rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with a supervisory authority.

10. How We Protect Your Data
We take appropriate technical and organisational measures to protect personal data against unauthorised access, loss, or misuse, including access controls, encryption where appropriate, and staff confidentiality obligations. No transmission over the internet is completely secure, but we work to protect your data and to notify you and the authorities of any breach where required by law.
11. Children
Our website and services are intended for a professional, adult audience (yacht buyers, brokers, and partners). We do not knowingly collect personal data from children. If you believe a child has provided us data, please contact us and we will delete it.
